Litigation & Court Proceedings
Whilst we endeavor to avoid the issue of court proceedings it is sometimes necessary to resolve disputes in court. Most construction and engineering disputes are dealt with by the Technology and Construction Court (TCC).
That court has been established to deal with such matters and has its own rules designed to assist in the speedy resolution of disputes.Before any proceedings can be commenced the parties have to complete the Pre Action Protocol for Construction and Engineering Disputes. This mandatory procedure is designed to ensure that all the issues that separate parties are investigated and explored by the parties and their advisors before proceedings are issued. The parties are required to meet with their advisors before the issue of proceedings in an attempt to resolve the dispute and avoid the need for court proceedings.
